These terms of trade are to be read in conjunction with your quotation.
Definition: JAK’s Awnings Ltd, trading as Cool Awnings further-to referred to as Cool Awnings.
50% DEPOSIT IS REQUIRED TO ACTIVATE THE MANUFACTURING PROCESS, WITH BALANCE PAYMENT ON THE DAY OF INSTALLATION
WARRANTY DOES NOT COVER MISUSE OR INCORRECT USE OF PRODUCT
WARRANTY CLAIMS WILL NOT BE ACCEPTED ON DEFAULT ACCOUNTS
THE TITLE OF THE GOODS SUPPLIED SHALL PASS TO THE PURCHASER WHEN FULL PAYMENT HAS BEEN RECEIVED TO COOL AWNINGS.
All quotations expire 30 days from date of issue.
Credit
For approved Credit account customers, payment is strictly nett 30 days from statement date. All overdue invoices and accounts are subject to a 4% per annum interest, accrued daily. Any costs incurred to recover debt will be added to the debt and will form part of the total debt to be recovered.
Cool Awnings have the right to enter the buyer's premises and repossess the goods if Cool Awnings don't receive full payment. When the goods have been mixed or on-sold, these rights will still apply if the products can be traced.
Cancellations
Written cancellations will only be accepted if the manufacture of the goods has not commenced.
Installation
Goods will be delivered or installed to the site address on the quote, unless otherwise advised in writing.
Installation is included unless otherwise specified. Ex factory or self installation products will be assumed to be collected from our factory in Panmure unless otherwise advise and will incur delivery costs if delivery is required.
Cool Awnings will cover the risk of damage to the product while in transit to site and will take all care to ensure the product is protected while being installed.
If the product is damaged onsite, without any Cool Awnings representative onsite, then the customer is responsible for damage.
Prior to installation the buyer is to provide clear access to the site, and a clear installation area to minimise risk of damage to the awning and buyers property, and to ensure safety for the installation team.
Due to the custom nature of the product, Cool Awnings will make all attempts to deliver within estimated delivery times. These estimated delivery times are a guide only and can change without notice. Cool Awnings will not be liable for any loss suffered by the customer due to unforeseen manufacturing delays.
Warranty
If the product is found to be defective then the product will be repaired or replaced as required in the CONSUMER GUARANTEES ACT 1993. However, if the goods or services are acquired for a business purpose the Act does not apply and the liability will be limited to the contract price.
Cool Awnings provide a 12 month to 10 year warranty, depending on the system and fabric purchased. Awnings have a minimum 5 year warranty for defects in materials and quality of work. Cool Awnings warranty does not cover any product that is ordered outside of manufacturers recommended specifications, that is faulty due to normal wear and tear, incorrect installation by installers other than Cool Awnings staff or contractors, accidental damage, negligence or improper maintenance or use. This warranty does not cover damage caused by weather.
Detailed warranty information will be supplied following installation.
Cool Awnings will cover freight costs for return of defect products.
